Terms & Conditions

1. Interpretation & Definitions

Words whose initial letter is capitalised carry the meanings set out below, whether used in singular or plural form.

  • "Application" — the VisaEase website and any associated web application accessible at visaeaseservices.in.
  • "Company" (also referred to as "VisaEase", "We", "Us", or "Our") — VisaEase Services, operating the Application and providing the Services.
  • "Service" — the visa appointment scheduling assistance and related services offered through the Application.
  • "Order" — a request submitted by You through the Application for visa appointment scheduling assistance.
  • "You" (also "Your" or "User") — the individual accessing or using the Service, or the legal entity on whose behalf such individual acts.
  • "Credentials" — the US visa scheduling website login details (username, password, and security questions & answers) that You provide to Us for the purpose of scheduling Your appointment.

2. Acknowledgement

  1. These Terms and Conditions govern Your use of the Service and form the agreement between You and the Company. By accessing or using the Application, You agree to be bound by these Terms.
  2. If You do not agree with any part of these Terms, You must not access or use the Application.
  3. This document is an electronic record under the Information Technology Act, 2000 and applicable rules, including the Digital Personal Data Protection Act, 2023. It does not require a physical or digital signature.
  4. You represent that You are at least 18 years of age. The Company does not permit individuals under 18 to use the Service.
  5. Your use of the Service is also subject to Our Privacy Policy, which describes how We collect, use, and protect Your personal information. Please read it carefully.
  6. You acknowledge that the grant or refusal of a visa appointment slot is subject to availability on the US visa scheduling system and the discretion of the US Embassy or Consulate. VisaEase facilitates appointment scheduling only and is not responsible for visa approval, rejection, or any Embassy decisions.
  7. You acknowledge that any estimated timelines displayed on the Application are indicative and provided on a best-effort basis. They are not binding on the Company.

3. Nature of Services

  1. VisaEase provides visa appointment scheduling assistance. We help You secure a US visa interview appointment at the earliest available date within Your specified timeframe and preferences.
  2. VisaEase does not provide visa consulting, immigration advice, form filling (e.g., DS-160), or any service related to the outcome of Your visa application.
  3. You are solely responsible for completing all prerequisite steps (DS-160 submission, visa fee payment, account creation on the US visa scheduling portal) before placing an Order with Us.

4. Placing an Order

By placing an Order through the Application, You warrant that You are legally capable of entering into binding contracts and that:

  1. All information You provide — including Your name, email, address, visa type, number of applicants, scheduling credentials, timeframe preferences, and exclusion dates — is true, accurate, complete, and not misleading.
  2. You grant Us the right to use the Credentials You provide solely for the purpose of scheduling Your visa appointment on the US visa scheduling portal.
  3. You shall verify all information at the time of submission. The Company disclaims liability for errors arising from incorrect information provided by You.
  4. You shall respond to any communications from VisaEase within 48 hours of receipt (excluding Sundays and public holidays). Failure to do so may entitle VisaEase to cancel Your Order, and You shall not hold VisaEase liable for any resulting delay or non-scheduling.

5. Credential Handling & Data Security

  1. Your Credentials are encrypted at rest using industry-standard encryption and transmitted over HTTPS (TLS 1.2+).
  2. Access to Your Credentials is restricted to authorised personnel on a need-to-use basis, solely for the purpose of fulfilling Your Order.
  3. We strongly recommend that You change Your visa scheduling portal password after Your Order is fulfilled.
  4. The Company shall not be liable for any unauthorised access to Your visa scheduling account that is not attributable to the Company's negligence or wilful default.

6. Quotation, Pricing & Fees

  1. After You submit an Order, the Company will share a quotation specifying the service fee. You may accept or reject the quotation through the Application.
  2. The Company reserves the right to revise pricing at any time prior to Your acceptance of a quotation.
  3. All applicable taxes (including GST) are Your responsibility and may be included in the quoted fee.
  4. If You reject a quotation, the Company may revise and reshare it. If no agreement is reached, the Order will be cancelled.

7. Payment Terms

  1. Payment is due only after the appointment has been successfully scheduled and confirmed. No advance payment is required.
  2. Payment may be made via UPI (QR code) or bank transfer using the details displayed on the Application.
  3. A GST invoice and receipt will be provided within 24 hours after payment is confirmed.
  4. The invoice link will be made available on Your Order detail page for download.

8. Appointment Scheduling Policy

  1. Appointments will be scheduled at the earliest available dates within Your specified timeframe, excluding any dates You have marked as unavailable.
  2. Single Scheduling Policy: Appointments are scheduled once based on the initial agreement. No requests for rescheduling will be accepted after the appointment has been booked.
  3. If rescheduling is necessary due to Your unavailability or unforeseen circumstances on Your end, it will be treated as a new Order and will incur a new service charge.
  4. Please inform Us in advance of any dates You cannot attend. We will exclude those dates when scheduling Your appointment.

9. Order Cancellation & Refunds

  1. We reserve the right to cancel Your Order for reasons including but not limited to: incorrect or incomplete information provided by You, failure to respond to communications within 24 hours, suspected fraud, or unavailability of the scheduling system due to circumstances beyond Our control.
  2. You may request cancellation of Your Order at any stage before the appointment is scheduled. Cancellation requests must be made through the Application. Approval of any cancellation request shall be at the sole discretion of VisaEase.
  3. Since payment is collected only after successful scheduling, refunds are generally not applicable. In exceptional circumstances, refund eligibility will be determined at the sole discretion of the Company.
  4. If documents or information required to process Your Order remain pending for a continuous period of 90 days from the date of request, Your Order shall be deemed automatically cancelled. No service fee shall be owed by You in such cases.

10. User Accounts

  1. When You create an account, You must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms and may result in termination of Your account.
  2. You are responsible for maintaining the confidentiality of Your account credentials and for all activities that occur under Your account.
  3. You must notify Us immediately upon becoming aware of any unauthorised use of Your account or any other security breach.
  4. You agree not to share Your account credentials with any third party.

11. Intellectual Property

  1. The Application and its original content, features, and functionality are and shall remain the exclusive property of the Company and its licensors.
  2. The Application is protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used without the prior written consent of the Company.

12. Links to Third-Party Websites

  1. The Application may contain links to third-party websites or services (including the US visa scheduling portal) that are not owned or controlled by the Company.
  2. The Company assumes no responsibility for the content, privacy policies, or practices of any third-party websites. You access them at Your own risk.

13. Restrictions on Use

You may use the Application for lawful purposes only. You agree not to:

  • Delete, modify, or tamper with any content on the Application, including legal notices, disclaimers, or proprietary notices.
  • Attempt to gain unauthorised access to any part of the Application, its servers, or any connected systems.
  • Use the Application to transmit any harmful, offensive, defamatory, or unlawful content.
  • Use automated scripts, bots, or scrapers to access or interact with the Application without prior written consent.
  • Impersonate any person or entity, or misrepresent Your affiliation with any person or entity.

14. Termination

  1. We may terminate or suspend Your account immediately, without prior notice or liability, if You breach these Terms or engage in any activity that is unlawful or harmful to the Application, its users, or the Company.
  2. Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your account, You may discontinue using the Service and contact Us.

15. Limitation of Liability

  1. To the maximum extent permitted by applicable law, the Company's total liability under these Terms shall be limited to the amount actually paid by You for the specific Order giving rise to the claim.
  2. The Company shall not be liable for any special, incidental, indirect, or consequential damages, including but not limited to loss of profits, loss of data, business interruption, or personal injury arising from Your use of or inability to use the Service.
  3. The Company is not liable for any consequences arising from visa approval, rejection, or delays by the US Embassy or Consulate. Our Service is limited to appointment scheduling assistance only.
  4. The Company is not liable for any unavailability of appointment slots on the US visa scheduling portal, system outages on third-party platforms, or changes to scheduling policies by the US government.

16. "As Is" & "As Available" Disclaimer

  1. The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  2. The Company does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
  3. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above limitations may not apply to You. In such cases, the exclusions shall be applied to the greatest extent enforceable under applicable law.

17. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) Your use of the Service; (b) Your violation of these Terms; (c) any inaccurate or incomplete information provided by You; or (d) Your infringement of any intellectual property or other rights of the Company or any third party.

18. Force Majeure

The Company shall not be held responsible for any delay or failure to perform its obligations if such delay or failure arises from circumstances beyond the Company's reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, war, terrorism, internet or telecommunications failures, or third-party system outages.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. The courts at New Delhi shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms. Your use of the Application may also be subject to other local, state, national, or international laws.

21. Dispute Resolution

In the event of any dispute arising out of these Terms, You shall first attempt to resolve the matter informally by contacting the Company. If the dispute is not resolved within forty-five (45) days, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. A sole arbitrator shall be mutually agreed upon by both parties; failing agreement within fifteen (15) days, the arbitrator shall be appointed in accordance with the provisions of the Act. The proceedings shall be conducted in English, and the seat of arbitration shall be New Delhi. The arbitration shall be completed within one hundred and eighty (180) days from the date of reference.

22. Severability & Waiver

  1. If any provision of these Terms is held to be unenforceable or invalid, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
  2. The failure of the Company to exercise or enforce any right under these Terms shall not constitute a waiver of such right.

23. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between You and the Company regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

24. Changes to These Terms

  1. We reserve the right to modify or replace these Terms at any time at Our sole discretion. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice before the new terms take effect.
  2. By continuing to access or use the Service after revisions become effective, You agree to be bound by the updated Terms. If You do not agree, please stop using the Application.
